TERMS AND CONDITIONS

These terms and conditions apply to the use of the balloonbay.co.uk website and the services provided by Balloonbay. These terms and conditions as stated on the website are subject to change without prior notice. Please read the terms and conditions (“Terms and Conditions”) set out below carefully before ordering any Goods or Services from us. By ordering any Goods or Services from us you agree to be bound by these Terms and Conditions.

 

1. PRODUCTS AND QUALITY

Balloonbay only uses the very best professional materials to ensure the best quality, we do not use decorations or balloons supplied by our clients.

Balloonbay takes no responsibility for the condition of your balloon decorations once we've departed from your venue, we always take photographs to show that we've fulfilled your order. 

 

11" latex helium balloons float for an average time of 8-14 hours (depending on environmental conditions and handling), should you require your latex balloons last longer please let us know, so we can pre-treat them with Hi-Float which will enable your balloons float for 2-3 days instead of hours - small fee applicable.

Please be aware heat, cold and static could reduce float times or even burst your balloons.

All balloons supplied on "DATE OF EVENT" are intended to last for that event, unless otherwise agreed & clearly stated on your invoice.

Client understands that some decor items may be affected by temperature and humidity and that Balloonbay cannot be held responsible for the decor in uncontrolled climate, such as rain or extreme heat and/or unforeseen acts of nature. In that case, Balloonbay has the option of making changes to the decor in the best interest of Client. We NEVER guarantee perfect results with balloon decor outdoors. However, we further state that we will do everything in our power to make sure the decor will hold up by using the BEST quality of balloons.

2. BOOKING

​

All booking is subject to these terms and conditions.

We work strictly on a first come first served basis so please book early. Last minute bookings may restrict the services we can offer you.

Confirmation of your booking will be emailed, please keep this as your proof of  booking.

Once a booking deposit/full balance where necessary, has been received, then your booking is confirmed.

Delivery charges range from £4 – £60 as established by post code. Additional charges may apply if set up is extremely early in the morning or late at night.

Please note that any changes to bookings must be made in writing and we will use our reasonable endeavours to accommodate these changes however we cannot guarantee that we will be able to accept the alteration. Where the change results in an increase in the overall cost a revised Invoice will be issued to you.

3. PRICES AND PAYMENT

​

The price of any service will be as agreed between us. All prices quoted are in pounds Sterling.

Bookings over £100 must be secured with a 30% non-refundable deposit at time of booking (due within 7 calendar days). The deposit amount will be deducted from your final balance which will be due no later than 1 week prior to your event date. Failure to do so could result in the loss of your deposit and cancellation of your booking without notice. It is the responsibility of the customer to pay on time.

All invoices must be paid in full by the date specified on the invoice.

Bookings made less than one week before the event or are under £100 require full settlement immediately. 

It is your responsibility to check the invoice thoroughly, this includes dates, times, venues, colours, quantities, spellings for personalised goods, etc. Please inform us of any mistakes immediately.

Payments may be made by cash, bank transfer or debit/credit card.

4. CANCELLATION AND REFUND

​

If you ordered the Goods or Services off-premises then you have the right to cancel your order within 14 days without giving any reason.

The cancellation period will expire 14 days after the day you placed your order provided that you have not asked us to perform the Services or deliver the Goods before this date.   

To exercise your right to cancel you must notify us immediately preferably by email or by calling us. You must provide us with a clear statement of your decision to cancel an order.

Please note that you have no right to cancel an order for balloons or hire Equipment once these have been delivered/collected.

We will charge the following fees should a cancellation occur:

Within 7 days of the event date. The full contracted fee.

Within 14 days of the event date 50% of the full contracted fee.

No cancellation fee payable if you cancel more than 2 weeks prior to the event.

The deposit will not be refunded under any circumstances and does not eliminate the full cancellation fee being charged.

In the unlikely event that WE have to cancel a booking due to reasons beyond our control, we will do so in writing or by email providing you with as much notice as possible, returning any deposits paid and where possible recommend another reputable company.

5. DELIVERY

​

The Goods or Equipment will be delivered by us to you on the agreed date and at the event location specified by you.

You must ensure that at the time of agreed delivery of the Goods or Equipment adequate arrangements, including labour and access where necessary, are in place. We cannot be held liable for any damage, cost or expense incurred to the Goods, Equipment or premises where this arises as a result of a failure to provide adequate access or arrangements for delivery. An extra charge may be made by us where we spend additional time due to delays with access to the venue.

6. ON THE DAY AND ACCESS TO THE VENUE

​

Balloon decorating is very time consuming, where possible we try to bring as much of the job already made up to save time at the venue, but larger orders, such as arches, etc require us to construct your balloon decor at the venue. It is essential that you've hired the venue for adequate time before your event to allow us to complete our work, this will be discussed with you at the time of booking. We also require a contact name and telephone number for the keyholder, should we need to make access arrangements with them. In the rare event of your venue not being accessible at the times pre arranged we will not be held responsible for any problems arising from this and will move onto our next booking.

Once displayed, we do not recommend relocating any displays we create. We will always state arrival time on your order form, it is the clients responsibility to ensure this is arranged. Where venue's are closed/not ready we are not responsible for any incomplete decor.

Once your booking is confirmed your invoice will clearly state 'required installation time', please ensure your venue staff are fully aware of this and do not put your event at risk of delay. In the unlikely event this happens, no refund will be available. For health & safety reasons it is important that the venue allows undisturbed working space and power supply for full working time on site. Please inform venue staff of our requirements.

7. HIRE OF EQUIPMENT

​

Some of our balloon displays require a hire of equipment. The hire period for the Equipment is for the period specified on the invoice. No extension to the hire period is permitted without our express written consent and receipt by us of the appropriate charge.

Full ownership in the Equipment shall remain fully vested in us at all times. You have no right, title or interest in the Equipment other than that you are entitled to hire the Equipment for the hire period.

You are responsible for the Equipment from the time we deliver the Equipment until the time you return the Equipment to us. Full risk in the Equipment shall lie with you during this time.

You are not permitted to hire, sub-let, sell, lend, or part with possession of the Equipment at any time.

Please ensure that the venue has in place adequate insurance to cover the Equipment against fire, theft, loss or damage at all times during the hire period.

You hereby indemnify us against any losses, costs, damages or expenses that we may reasonably incur as a result of your breach of any of these Terms and Conditions.

Hire these equipment require a refundable security deposit. The deposit is refunded to you on their safe return after inspection. Any lost or damaged equipment will be charged for and safety deposit will not be refunded. Unless specified in your invoice. Where hire equipment is left at the venue overnight, customer is still liable at all times.

If the Equipment is returned to us is in bad condition, damaged, unclean or defective in any way then we are entitled to retain any security deposit which may have been paid by you to repair and/or replace the Equipment. You are liable for any additional costs that we may incur in repairing, cleaning or replacing the Equipment.

In the event that any item of Equipment is lost, stolen or damaged beyond economical repair you are liable to pay us the cost of the replacement items as new. You will not be entitled to a refund of the security deposit in these circumstances

In the event of loss or damage, the security deposit will be retained by us and we will notify you in writing of the reasons. If the cost of replacement due to missing Equipment or damage is in excess of the security deposit, an invoice will be issued to you to cover the cost of the damaged/missing property which must be paid in accordance with the terms stated on the invoice. If the cost of replacement is less than the security deposit, the balance will be returned to you within 14 working days of the date of our assessment.

8. HEALTH AND SAFETY

​

Helium gas is not poisonous, be advised that it is not recommended for human consumption.

We will not be held liable in the case of fire caused by the use of candles used in centerpieces, by ribbons being caught alight.

Discard broken balloons immediately.

Latex Balloons are not considered safe for children under 36 months old. Young children could choke or suffocate on uninflated or burst balloons. Responsible adult supervision is highly advised at all times for children under 8 years of age.

Raffle prize gift vouchers cannot be used in conjunction with any other offers (only one raffle prize gift voucher per order) and cannot be used for delivery and setup charges.
